General Terms and Conditions

Scope

These General Terms and Conditions (GTC) apply to all contracts between Moon & Kings Union GmbH, Hauptstraße 12, 89143, Blaubeuren.

Conclusion of Contract

The contract is only concluded after the customer has contacted us via email or contact form and a written agreement has been reached. The order confirmation will then be sent in writing or electronically.

Prices and Payment Conditions

  • All prices are net plus applicable value-added tax.
  • A deposit of 30% of the total amount is due within 20 days upon receipt of the invoice. Only after receipt of the deposit will the goods be prepared and packed for shipment.
  • The remaining balance of 70% is payable within 30 days after receipt of the goods.
  • Payments are made via bank transfer or by other mutually agreed-upon means. All bank charges are borne by the customer.

Delivery Conditions

  • The delivery time is usually 20 from receipt of the deposit payment.
  • Delivery is made to the delivery address specified by the customer.
  • The risk of accidental loss and deterioration of the goods passes to the customer upon handover to the transport company.
  • If we cannot meet the delivery period of 20 days for reasons beyond our control, the delivery period automatically extends by another 20 days. The customer will be promptly informed in such a case.

Retention of Title

The goods remain the property of the seller until full payment of the purchase price.

Warranty

The statutory warranty period of 12 months applies from the delivery of the goods.

Claims for defects by the customer require that they have fulfilled their inspection and complaint obligations in accordance with § 377 HGB.

In the event of justified defects, the seller will provide rectification or replacement delivery at their discretion.

Further claims by the customer, in particular claims for damages, are excluded unless they are based on intent or gross negligence of the seller or their vicarious agents.

The seller collects, processes, and uses the customer’s personal data exclusively for the purpose of contract processing and within the framework of legal provisions. For further information, please refer to our privacy policy.

Final Provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The place of jurisdiction for all disputes arising from the contractual relationship is the seller’s place of business.

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall not be affected. The parties undertake to replace the invalid provision with a valid provision that comes closest to achieving the economic purpose of the invalid provision.
